1. Definitions
"Platform" refers to Puntazo Fantasy, accessible at puntazofantasy.com. "Company", "we", "us" refers to Wombi Enterprises Ltd, a private limited company incorporated in Cyprus (registration number HE437408), with registered address at Efesou 9, 5280 Paralimni, Cyprus. "User", "you" refers to any individual who accesses or uses the Platform. "Service" refers to the fantasy sports prediction game provided through the Platform. "Virtual Points" refers to the non-monetary scoring units earned through correct predictions.
2. Acceptance of Terms
By creating an account or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.
3. Service Description
Puntazo Fantasy is a free fantasy sports platform where users predict the outcomes of professional padel tournaments through two game modes: Bracket Predictions and Pick 5. Users earn virtual points based on the accuracy of their predictions and player selections. The Platform is provided purely for entertainment purposes.
4. Eligibility
You must be at least 16 years old to use the Platform. By accepting these Terms, you confirm that you meet this minimum age requirement. We do not knowingly collect data from individuals under 16. If we discover that a user is under 16, their account will be terminated immediately.
5. User Accounts
Each person may create only one account. You must provide a valid email address and verify it before your account becomes active. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately if you suspect unauthorized access to your account.
6. Game Rules and Scoring
Before each tournament, users can participate in one or both of two game modes. In Bracket Predictions, users predict the winners of each match in the bracket; predictions must be submitted before the published deadline; picks must follow each user's own bracket progression and are only available once both sides of a match are known; points are awarded progressively by round, with upset multipliers applied in specific cases, and ties are resolved first by how close the predicted final score is to the actual final score when a valid final score exists and, if still tied or if that criterion does not apply, by submission time. If the final ends in retirement, the recorded score up to retirement is used; if it ends in walkover, submission time decides tied scores. In Pick 5, users select 5 individual players per tournament; scoring is based on Puntazo's proprietary fantasy stage table, which depends on the tournament category and the best round each selected player has secured or reached in that tournament. Bracket-mode upset multipliers do not apply in Pick 5. Each player can be picked a maximum of 3 times per season. The scoring system may be adjusted for future tournaments with prior notice, and the Platform may recalculate points for an ongoing or completed tournament to correct errors, resolve data issues, or apply the published rules correctly.
7. Groups and Prizes
Users may create or join private or public groups to compare predictions with friends. The Platform does NOT offer, manage, intermediate, or guarantee any prizes. Any arrangements regarding prizes or rewards between group members are private agreements made at the sole responsibility of the users involved. The Company has no involvement in, and accepts no liability for, any such arrangements. The creator of a group that offers prizes is solely responsible for their fulfillment, delivery, and any tax or legal obligations arising therefrom. The Platform does not act as an intermediary, custodian, or guarantor of any prizes.
8. Virtual Points
Virtual Points have no monetary value whatsoever. They cannot be redeemed, exchanged, transferred, or sold for real money, goods, or services. Virtual Points exist solely as a game mechanic for entertainment and ranking purposes within the Platform.
9. Intellectual Property Disclaimer
Puntazo Fantasy is not affiliated with, endorsed by, or connected to Premier Padel, the International Padel Federation (FIP), or any professional padel player or organization. Tournament names, player names, and related information are used solely for identification and informational purposes within the context of the fantasy game. All trademarks and intellectual property belong to their respective owners.
10. Data Source Disclaimer
Tournament data, draw information, and match results are obtained from publicly available sources. While we strive for accuracy, we do not guarantee that this information is complete, accurate, or up to date. Scoring and rankings are based on the data available to us and our determinations are final.
11. Acceptable Use
You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorized access to the Platform or other users' accounts; (c) use automated tools, bots, or scripts to interact with the Platform; (d) interfere with or disrupt the Platform's operation; (e) impersonate another person or entity; (f) create multiple accounts; (g) harass, abuse, or threaten other users; (h) use the Platform for any form of gambling or betting.
12. Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In any event, the Company's total aggregate liability shall not exceed one hundred euros (EUR 100). Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
13. Account Termination
We may suspend or terminate your account at our discretion if you violate these Terms, engage in prohibited conduct, or for any other reason with reasonable notice. You may delete your account at any time through the Platform settings. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.
14. Modifications to Terms
We may update these Terms from time to time. We will notify users of material changes at least 30 days before they take effect by posting a notice on the Platform and/or sending an email to registered users. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus. If you are a consumer residing in the European Union, you also retain the protection of the mandatory consumer protection provisions of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under EU law.
16. EU Online Dispute Resolution
In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform, available at: https://consumer-redress.ec.europa.eu. We are not obliged and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board, but we will consider participation on a case-by-case basis.
